Tennessee divorce laws call for an equitable division of property. Parties subject to a divorce may reach an agreement on how to divide their property, or they may take their case to trial and let a court determine how to divide their property in an equitable fashion.
The term equitable does not necessarily require an equal 50/50 split of the marital estate. A court will take into account many factors when determining how to divide property in an equitable manner.
The court will first characterize property as marital property or separate property. Marital property generally includes all property acquired during a marriage, subject to a few limited exceptions such as property acquired by inheritance or gift. Once a court characterizes property, it must assign a particular value to the property to determine how to equitably divide the property between the parties.
