Relocation/Move-Away

Parental Relocation

Often, after a divorce is final or legal parentage has been established, one of the parents may want or need to move out of the area. When the other parent stays behind, efforts to move away can be difficult. You want an experienced lawyer to guide you through the process.

Family Law Attorneys Jeffrey L. Levy and Mary Langford bring considerable experience to parents who have questions or concerns about relocating. Jeffrey L. Levy has focused on family law matters for more than 13 years. Mary Langford has represented family law clients since 1999. We will work closely with you to identify and implement solutions that are in the best interests of your children, but that also protect your rights as parents.

Protecting Parents in Relocation and Move-Away Situations

We will work with custodial or noncustodial parents in cases involving requests for relocation, which are also known as "move aways". We understand the factors the court considers and know how to put together a proposal for relocation that will be more likely to be approved by the court. Equally, if you are the parent not looking to move, we can help you resist an attempt to take the children away from you. We can help you craft parenting schedules, including transportation and other logistics, which will demonstrate to the court that you have your child's best interests at heart. If appropriate, we can help you as you seek a change of custody.

When you retain us to assist you in a relocation or move-away matter, we will help you determine the benefits and consequences of such a change for your children. We will help you work with your ex-spouse to set up an agreement where both parents can retain a constructive and meaningful relationship with the children. If both parents cannot reach agreement, we will argue your case forcefully in court.
